Repressing the Message and Method: Zimbabwean Efforts to Enact Digital Control

The fall of Robert Mugabe in late November is likely to usher in a new era of free digital expression in Zimbabwe. In the wake of his ascent, the now-fallen president initiated an era of repression, as evidenced by Freedom House’s 2017 ranking of Zimbabwean political freedom at 32 out of 100.

Most of the international community expressed concern about the deteriorating, and at times brutal, human rights conditions. Mugabe’s authoritarian grip also extended to the digital space through a series of unconventional measures aimed at eliminating the ability of opponents to use direct messaging applications to criticize the regime. The constriction on direct communication methods reflects the unique tendency for digital repression in African states to focus on mobile phones, given that many depend on such devices for digital access.

The goal was to silence the online activities of Zimbabwean journalists, human rights defenders, and pro-democracy activists. What is unique for Zimbabwe is that there was less concern regarding controlling social media—Facebook, Twitter, YouTube, and other blog-hosting platforms remained accessible while government-sponsored information communications technologies (ICT) repression zeroed in on direct messaging applications.

Since 2013, bulk text messages with political content had been subject to censorship, restricting the ability of civil society groups to communicate with one another. In October 2015, an opposition party councilor in a rural province was arrested for allegedly demeaning President Mugabe in a WhatsApp message to a private chat group with other regional councilors. WhatsApp was also shut down for five hours on July 6, 2016 during anti-government protests. As a result, a culture of self-censorship emerged.

A 2016 survey by Afrobarometer on perceptions of citizen engagement with leaders showed that 86 percent of respondents indicated they do not engage with leaders out of fear of violent reprisals, despite the finding that 75 percent of respondents believed engagement was important.

That was the case until #ThisFlag, an unplanned social media campaign, went viral in April 2016. Evan Mawarire, a pastor, posted a video on Facebook that inspired Zimbabweans at home and in the diaspora to post videos of themselves draped in the national flag and calling for government reforms to address the numerous serious issues facing the country. Significantly, it also sparked offline actions, including a public debate and protests.

Shortly afterward, Mugabe’s government proposed a new “cybercrime” bill that took a rather unconventional approach to the problem: the bill allowed the government to install a forensic tool on its citizens’ devices to monitor use of the Internet. Other troubling aspects included the prospect of jailing Zimbabweans who “abused” social media for up to 10 years. Foreign-based Zimbabweans “who cause harm back home” using social media or any other computer-based system could be extradited and prosecuted. As of October 2017, the bill had yet to receive a vote in the country’s parliament.

Mugabe also was set on establishing a new Ministry for Cybersecurity in 2017, a plan widely criticized. A government representative explained that the Ministry’s mission would have focused on eliminating “abuse and unlawful conduct” in cyberspace like “a trap used to catch rats.”

For Zimbabwe, Internet penetration rates have been rising steadily, including over the last several weeks. Since the state still owns the country’s digital and telecommunications infrastructure, there is a risk of backsliding to Mugabe-era restrictions on digital freedom. On a more positive note, however, the new president, Emmerson Mnangagwa, has collapsed the cyber security ministry established by Mugabe and placed it under the control of the ICT Minister.

As the year comes to a close, it’s worth a reminder that digital freedoms are in need of constant and vigilant defense. Zimbabwe is only slightly unique in its targeting of direct messaging applications. Even Western states such as the United States and the U.K. have called for backdoors in digital messaging apps under the rationale of fighting terrorism.

Preventing the encroachment of digital freedoms is a global project in need of context and perspective. The scale between repression in the West and repression in the Zimbabwe is not all that extreme. The lessons of Zimbabwe should serve as a warning about the fragility of digital freedoms as we move into 2018.

Press Release: The Niskanen Center applauds new letter in support of Mueller’s investigation

WASHINGTON, D.C., December 22, 2017— The Niskanen Center welcomes today’s release of a letter in support of special counsel Robert Mueller by prominent Republicans. The letter was organized by Richard Painter, who served as President George W. Bush’s chief ethics lawyer, along with former Members of the U.S. House of Representatives Christopher Shays (R-CT) and Mickey Edwards (R-OK).

The letter reads in part: “As Republicans and/or conservatives, including those who have served in elected and appointed positions, we reject recent efforts to discredit [Mueller]. These efforts undermine the institutions that protect the rule of law and so our nation. Mueller must be allowed to complete his investigation without interference.”

Brink Lindsey, Niskanen Center vice president and director of the Open Society Project, spoke in support of the letter: “We are proud to have organized Meetings of the Concerned for prominent Republicans and conservatives who oppose the president and his baleful influence over their party and movement. Today members of this group have joined with other Republicans who have held prominent positions in government to support special counsel Robert Mueller’s investigation against a growing chorus of attacks from the right.”

Lindsey added, “We commend their patriotism in upholding the vital principle of the rule of law at a time when all too many Republicans have chosen to value narrow partisan advantage over basic American values.”

Comments Submitted for New Visa Applicant Information Collection

This letter is in response to the Department of State’s request for comments on the 30-Day
Notice of Proposed Information Collection: Supplemental Questions for Visa Applicants.
The Niskanen Center has concerns about a number of substantive and procedural provisions in
the rule, detailed below. We conclude our comments with a list of recommendations:

  • Provide more information about who may be subjected to more rigorous review and what
    objective standards should be used by a consular officer to determine whether an
    individual “appears” to need more rigorous evaluation;
  • Provide more information about the scope of collected materials;
  • Provide more information about what type of social media accounts must be provided;
  • Clarify what pieces of information may provide grounds for visa denial if not provided;
  • Clarify the standard of review consular officers should use when conducting a “more
    rigorous evaluation;”
  • Provide an appeal process to rebut erroneous information gleaned from social media
    accounts; and
  • Require an annual report detailing to whom rigorous evaluation was applied—including
    country of origin, sex, race, and religion—what information was collected, and the
    outcome of the visa application.

For your consideration, we submit the following comments for your review.

I. Define the scope of each type of information collected, including examples of sufficient evidence.

The procurement of additional documentation that helps identify and thoroughly vet visa
applicants is in the interest of our national security, provided the collection of information is
thoughtful and efficient.

Additional documentation becomes counterproductive and unnecessarily onerous when the scope
of collected information is ill-defined. Specifying what information is necessary, and what type
of evidence (oral or documentary) is necessary to fulfill the requirements is critical to ensuring
the standards are not applied discriminatorily or arbitrarily.

For instance, clear guidance determining how an individual can demonstrate the “source of
funding for travel” will ensure that consular officers have a standard by which to review the
information. Whether this includes bank statements, an affidavit, or credit card receipts could
mean the difference between an abundance of useless information and an efficient review.

Additionally, social media information requests should specify the specific platforms and
identifiers being requested . For example, requesting Twitter and Facebook handles is
reasonable, whereby requesting an exhaustive list of accounts that may include, for example, an
old Myspace account or a Pinterest username would not only be useless, but will clutter the
information that a consular officer must review and place an undue burden on individuals who
cannot be reasonably expected to provide a truly exhaustive list.

II. Increasing the effective standard of review is unnecessary and ineffective.

Specifying ‘a more rigorous evaluation of applicants’ effectively institutes a higher standard of
review than that mandated by Section 291 of the Immigration and Nationality Act (8 U.S.C.
§1361). The statute specifies that the “burden of proof shall be upon such person to establish that
he is eligible to receive [a visa], or is not inadmissible […] and, if an alien, that he is entitled to
the […] status claimed.” The statute further establishes that an applicant must meet that burden of
proof “to the satisfaction of the consular officer.”

Subjecting certain applicants to a “more rigorous” evaluation standard could have two possible
implications: 1) it could effectively raise the evidentiary standard for a subset of applicants by
suggesting that those applicant must more than satisfy the consular officer; or 2) it could sustain
the current standard but with a greater amount of evidence collected from that subset. For
reasons detailed below, additional guidance is needed to ensure that the latter is the only effect
and that the standard of proof is not effectively increased.

The burden of proof established by current standards balances the need to identify reasons an
applicant may be ineligible for a visa with the benefits associated with granting a visa to a desirable applicant. In other words, a standard of review should be sufficiently rigorous to screen
out applicants who pose a threat to national security, while not being so onerous as to
significantly deter lawful migration or screen out many applicants who pose no threat.

That balance is promoted under the present standard, established by statute, wherein the consular
office denies an application if an applicant fails to establish “to the satisfaction of the consular
officer” that he is eligible to receive a visa or other document for entry, or is not inadmissible.

No evidence is promulgated indicating that the current consular evaluation is inadequate, nor
does evidence exist suggesting that ‘a more rigorous evaluation’ that raises the standard of
review will result in a more optimal balance between screening out migrants who pose a risk and
facilitating migration that is in the national interest. The most realistic consequence of effectively
increasing the burden of proof is that it will result in discriminatory or arbitrary application of
additional evaluation criteria, increase work for consular officers and embassies, and ‘chill’ or
depress lawful immigration.

On its face, the two standards seem relatively similar; however, in practice, they are not. Where a
consular officer is expected to apply one standard of proof, he may use all available evidence
accompanying a given petition to make a judgement about whether he is satisfied that the
applicant is in fact eligible for a visa. But where a consular officer is expected to apply a stricter
standard of proof in a subset of cases, eligible applicants will fail the rigorous evaluation even
when the consular officer is satisfied that the applicant is eligible.

III. The proposed collection of information will result in a substantially longer time and cost burden and will likely decrease the quality and clarity of the information collected.

An application for a visa consists of two aspects of evidentiary value: 1) documentation, and 2)
the interview; the only evidence that can adequately satisfy a more rigorous evaluation is
additional documentation.

Pursuant to U.S. law, all consular officers responsible for adjudicating visa applications must
receive specialized training in effectively screening visa applicants. Additionally, the consular
officers receive training in detecting fraudulent documents and general document forensics.
Training also includes working with immigration officers conducting inspections of applicants
for admission into the United States at ports of entry.

Consular officers are trained to quickly assess the unique circumstances of a case to assess the
purpose, profession, travel history, family, and finances of an applicant, supplementing their
assessment with questions during an interview. Documents provided by applicants may help to
assess their purpose and intent, but often are not the most effective technique for determining
eligibility.

Requiring applicants to provide additional documentation is burdensome. Practically, many
applicants do not have access to necessary documentation, and documents are often in their
native language, which isn’t easily translatable to the consular officer. Additionally,
documentation may be more irregular, less uniform, or harder to obtain in numerous countries of
origin. Finally, excess documentation can become overly burdensome for the consular officer to
review, and will add significant processing delays, due to review time and record keeping.

Not only is additional documentation unnecessary for consular officers, there is no evidence that
it is necessary. In 2015, over 1 million applications for immigrant and nonimmigrant status were
denied for failure to comply with provisions of the Immigration and Nationality Act (INA); in
total, over 3.3 million applications were denied, based on over 3.4 million determinations of
ineligibility grounds, suggesting that our review procedures are thorough.

Even if the assertion exists that supports the need for increased capture of erroneous applications,
there is no evidence suggesting that more rigorous evaluation will effectively increase accuracy
in identifying ineligible applicants. More likely, the burden will operate as a bar to some number
of legitimate immigrant applicants. No evidence has been promulgated suggesting that the
benefits from increased identification of ineligible applicants outweighs the costs of increased
denials of eligible applicants.

Altering the review process in this way hamstrings the ability of consular officers to use their
experience and discretion, will take up an increasing proportion of their time sifting through new
documents they have not previously needed, and will not meaningfully promote safety.

IV. Standards for collection and use of social media should be required prior to
implementation.

The use of social media is a key vehicle for delivering and acquiring information quickly and
reliably, making it prudent for background analyses to use social media as an element in the broader concept of collecting information. However, any assessment of social media must
include careful consideration of the relevance of various behaviors on social media, the
credibility of statements made on social media, and the potential for bias and false assumptions
among those processing social media data, as with all other sources of complication.

Ensuring data quality, source credibility, and addressing potential bias is critical to ensuring that
immediacy does not outweigh accuracy. The risk of failing to institute safeguards and checks is
that erroneous or misleading information can be gleaned that may be difficult for an applicant to
rebut. The widespread use of sarcasm, deadpan, irony, obscure references, and outright
provacateurship can make it difficult to assess the intent of comments made on social media.
Additional guidance is needed to ensure there are protections for eligible applicants whose social
media behavior could be misinterpreted.

Platforms that encourage more interactivity and freedom often have the fewest traceable
qualities. On these sites, for example, an “About me” section on Facebook or Twitter rarely
offers any true information about the author. When evaluating information collected from social
media, it is important to take the time to validate the content and evaluate the sources, which
requires development of a robust methodology.

Standards guiding the level of review, as well as the weight of information gleaned from social
media are critical to ensuring that social media becomes a useful tool in background checks,
rather than one that leads to denials of eligible applicants who pose no serious risks.

V. The Department of State should provide an annual report detailing the visa applicants required to submit additional information, the type of information requested, details of the submission, country of origin, and the outcome of the determination.

Requiring an annual report detailing the methodology and outcomes of the proposed collection
framework will act as a safeguard against discriminatory or arbitrary practices, ensure that the
safeguards are working as intended, help assess the costs and burdens associated with the new
documentation, and will help determine the overall effectiveness of the measures.

Recommendations

The Irrelevance of Trump’s National Security Strategy

The Trump administration is poised to release its first National Security Strategy (NSS) today. For months, there has been speculation about what the document would contain given the president’s views and the more conventional outlook of leading national security officials in his administration. And in the lead up to its release today, there has been disagreement over what the strategy will contain.

A recent story by Kate Brannen at Just Security points to how “non-Trumpian” the 70-page NSS will be. That administration officials might ignore Trump’s professed foreign policy inclinations would be a good thing given how dangerous his worldview, if implemented, would likely prove. However, others have reported that the document will emphasize themes the president has repeated—such as sovereignty and nation-states in “perpetual competition”—both on the campaign trail and since taking office.

There are two reasons why this speculation is likely to be all for naught though. On the one hand, the NSS has rarely—if ever—mattered. And on the other, Trump’s National Security Strategy is even less likely to matter because of Trump himself.

First, on the general lack of relevancy of the NSS as a strategy document, it is unclear it actually serves its intended purpose. The purpose of any strategy is to set priorities. However, the process by which the strategy is made prizes consensus over prioritization. As I wrote earlier this year when speculation was ramping up about Trump’s National Security Strategy,

Part of the reason for the vacuity of the NSS is that the process that produces the myriad documents that are supposed to guide American strategy is more likely to inhibit creative thinking than facilitate it. The NSS is supposed to set the terms for the National Defense Strategy, produced by the Office of the Secretary of Defense. Myriad programmatic guidance is supposed to flow from there.

 

The NSS is supposed to be produced annually. It is not. And it never has been. So what’s the point? The Pentagon continues to operate in its own flawed and inefficient manner. There is no evidence to suggest that the formal planning process has led to a more efficient national defense enterprise. The process is supposed to produce tradeoffs. Instead, the need for consensus leads to watered-down “plans” that reflect the preferences of the bureaucracy.

At best, the National Security Strategy—like the plethora of other such reports that are intended to guide America’s foreign policy and national security decision-making—is a marketing document. Marketing is important in certain respects. It sends signals to allies and adversaries alike. As political scientist Daniel Drezner wrote in Foreign Affairs in 2011:

[I]n times of deep uncertainty, a strategy can be important as a signal device. In these moment, such as the present a clearly articulated strategy, matched by consistent actions is useful because it can drive home messages about a country’s intentions to domestic and foreign audiences.

But that marketing function raises the second reason Trump’s National Security Strategy will be irrelevant. Even if the NSS contains elements reflecting his foreign policy advisors’ more conventional preferences, Trump has proven himself too undisciplined and mercurial to stick to the script. Moreover, the president’s domestic policy advisors—namely, Stephen Miller—often represent a countervailing force. For example, a lengthy Washington Post report on Trump’s relationship with Russia also describes the great lengths National Security Advisor H.R. McMaster had to go to earlier this year to ensure the president finally reaffirmed America’s Article 5 commitment to its NATO allies after Miller had stripped it from a previous speech in Brussels.

But Trump’s tendency to still cut against McMaster’s preferences remained evident just a few weeks before the National Security Strategy’s release. At a rally in Pensacola, Florida where most of the attention focused on the president’s endorsement of Roy Moore’s candidacy for Alabama’s Senate seat, Trump threw in a number of jabs at America’s allies—once again implying that he views NATO as something akin to a protection racket.

Kori Schake, a scholar of American civil-military relations and former official in the Bush administration, noted the passage on Twitter: “This is the stuff that will make all the temporizing wording of the forthcoming nationals security strategy irrelevant: the President clearly doesn’t believe it.”

Whether the National Security Strategy is “Trumpian” or not will be decided after its release today. But at its best, the National Security Strategy can serve as a marketing document. Yet as a marketing document, Trump’s National Security Strategy will likely fail given Trump’s own inconsistencies. The president will most likely fail to stick to McMaster and company present to him because it either clashes with his worldview or because he is simply too undisciplined. Either way, it will render a document of already tenuous relevancy completely irrelevant.

Commercial real estate data firm, Xceligent, which is owned by General Trust and Daily Mail (DMGT) has filed for Chapter 7 liquidation. This news comes about 12 months after Xceligent started its legal battle with commercial real estate data firm Costar. 

Xceligent has over 250 employees which were sent a memo at 4:08 pm on 12/14/17 telling them their employment was being terminated that day. They only have 30 minutes to gather their stuff and leave the premises.

What is a Chapter 7 Bankruptcy?

It’s the most common and simplest form of bankruptcy that an individual or company can file. Any assets that the debtor does not have exempted a court appointed trustee may sell and then distribute the net proceeds to creditors. In exchange for this the debtor gets released of his personal liability for most debts. In most cases the case gets closed by the trustee without selling any of the debtors assets

According to DMGT it will have no liability for the legal costs it incurred with Xceligent.

China and the United States: Activist Investment and Merger Strategies in the Tech Industry

The technology market is constantly evolving, with Internet-based technological disruption impacting not only other technology markets, but non-technology sectors as well. Virtual reality is forcing realignments in the mobile app and smartphone markets, as well as forcing realtors to reimagine their marketing strategies. New context-aware applications and AI are contributing to rapid advancements in autonomous vehicle technologies, but are also increasingly contributing to efficiency gains in logistics and manufacturing. In the United States, these technologies are driving a new wave of innovation; but they’ve also driven renewed interest in the antitrust concerns associated with mergers and acquisitions, especially in the context of “Big Tech.”

Firms typically make merger and acquisitions (M&A) centering on their competencies and primary business activities to enhance synergies. That’s why Facebook acquired WhatsApp, Microsoft bought out Linkedin, and Google gobbled up Nest. Tech companies have been eating up startups in order to achieve economies of scale, expand global business reach, or grow their market positions.

The underlying logic of M&A strategies is straightforward. If market dominance is what tech companies care about, focusing on a core ecosystem is always better than dispersing smaller investments across many companies. Holding a fraction of shares in an emerging tech startup whose business is tangential to the company’s value chain involves a high level of risk. Startups are a risky proposition with promises of uncertain returns on investment to larger firms. If a startup dies, investors suffer losses; if it survives, it’s hard to efficiently protect interests as a minority shareholder.  When was the last time you saw Apple investing in an individual app developer, or eBay investing in its platform sellers?

It is also worth noting that U.S. tech sector has become one of the primary targets of activist investors in recent years. According to a BCG report, a typical S&P 1500 company has a 13% chance of becoming an activist target, whereas the likelihood rises to 22% for technology companies.

Maybe these strategies are unique to the American technology sector. How do things look in China by comparison?

Baidu, the Chinese variant of Google, possesses similar core competencies to its American counterpart, focusing on advertising services and search traffic. Yet it recently invested in O2O, a food delivery business that operates in a market where physical advertising promotion and logistics operations are the keys to market success. Similarly, Alibaba, China’s Amazon-eBay-Paypal equivalent, spent billions of dollars investing in entertainment. Why have Chinese tech firms been more willing to make investments in markets outside their traditional spheres of market success, while their American counterparts remain more steadfastly committed to core investments?

The fierce oligopolistic competition among Baidu, Alibaba, and Tencent (BAT) in China’s capital market has resulted in various proxy wars, in which new entrants are supported by one of the dominant players to leverage against other BAT firms. Tencent (social media) supported JD.com (e-retail) to counter Alibaba (e-commerce). In America, the equivalent scenario would be Google and Apple leveraging Amazon through equity purchases in eBay. At the same time, Alibaba has been buying stocks in Social Network Service (SNS) firms, such as Weibo, to counter Tencent’s Wechat service, the most widely used social app in China.

Such proxy battles have resulted in a slew of billion-dollar unicorns emerging in the Chinese tech market, such as Didi, Meituan, Elema, Mobike, and ofo. In each case, these startups experienced exponential growth as a result of the capital support of at least one BAT player. This process provides new players with opportunities to capitalize on such conflict, helping them not only survive, but thrive. Thanks to these dynamics, the birth rate of Chinese unicorn startups has been increasing as well.

The over-diversified investment strategies of Chinese tech giants are made possible by essentially three advantages: Variable Interest Entities (VIE), a policy system favoring industry over capital, and high-yield stocks that make investors happy.

A VIE is an entity in which an investor has a controlling interest, but which does not premise organizational control on a majority of voting rights. VIE has long been a popular structure for foreign parties investing in sectors that are restricted by China’s industrial policy, and has been adopted by many of China’s most well-known offshore-listed companies to attract foreign venture capital financing and complete offshore listings (primarily in the United States and Hong Kong). Even if international hedge funds wanted to exert control over their foreign investment interests, the vague regulations imposed by the Chinese government—without any clear prohibition against, or expressed endorsement of, the VIE structure—makes it very hard for these fund managers to do so.  

Second, for tech giants in China, there is rarely pressure from protected investors to force the decision to make changes to a board of directors. And when these firms have an initial public offering, they are simply too big to be threatened, as the restrictions on financing, leverage, and merger further protect their governance role in the board.

Finally, revenue at Baidu, Alibaba, and Tencent has remained steady and growth has been strong. The result has been high-yield stocks distracting investors from other, perhaps more structural, concerns.

All of these issues, in combination, produce a system that tends to favor broader diversification of investments beyond what domestic American tech companies might be willing to tolerate. In comparison, the United States has a capital market where activist investors are empowered by finance regulations to impose pressure on corporations to maximize shareholder value, especially in the short-term. However, the success rate of activists battling against corporate boards has been increasing. The win rate of activists battling for a seat on a company’s board rose from 52 percent in 2012 to 73 percent in 2014. And within 18 months after an activist investor joined their board, 44 percent of companies replaced their CEOs. Examples include the split of eBay and Paypal, the buy-back of Apple, and the post-merger breakup of DuPont and Dow Chemical amid investor unease.

With the presence of activist investors on a board, extra caution is always advised when making investment decisions. Otherwise, uncertain and potentially dramatic battles may lie ahead. Take the eBay-Paypal split for example: after eBay resisted Carl Icahn’s calls for heavy restructuring, including a Paypal spinoff, Icahn launched a proxy fight to control the San Jose company’s board.  

It may be time to rethink the role of activist investors and whether they are doing any good for America’s tech industry. As a recent Wall Street Journal op-ed noted, “Activism often improves a company’s operational results—and nearly as often doesn’t.” Given the slowdown of the American unicorn startup community’s growth, the role of activist investors is worth examining.
